NEPSAPP's Customer Privacy Data Statement

We value the trust you place in us and recognize the importance of secure transactions and information privacy. NEPSAPP has been providing various services and information about the different products and services through the NEPSAPP Website, Social Media Channels, and Mobile APP. These platforms facilitate customers for receiving Online Food Ordering, Hotel Aggregator and Restaurant Table Booking System, many Product and Service Information, Self-Care Service, Package Subscriptions, Rewards Points Loyalty Points, Bonus, NEPSAPP Coins etc. This Privacy Policy page is used to inform visitors regarding our policies with the collection, use, and disclosure of Personal Information if anyone decided to use our Service.

Many of our restaurants are owned and operated by franchisees, who are independent businessmen and women. This Privacy Statement does not apply to our franchisees or to websites or mobile apps that they operate. Please reference our franchisees’ privacy notices for information on how they collect and use customer information. If you choose to use our Service, then you agree to the collection and use of information in relation to this policy. The Personal Information that we collect is used for providing and improving the Service. We will not use or share your information with anyone except as described in this Privacy Policy. By visiting the Platform, providing your information or availing our product/service, you expressly agree to be bound by the terms and conditions of this Privacy Policy, the terms of use and the applicable service/product terms and conditions. If you do not agree, please do not access or use our Platform.

We may collect personal information about you when you visit our restaurants, use our websites or mobile apps (“online services”), and otherwise interact with us (collectively, “services”). The information we collect falls into three categories:

    Generally, you are under no obligation to provide your personal information. However, in certain cases, we may be unable to provide you with our services unless you provide your personal information.

For example, when you add a method of payment to your profile in our mobile app, we may combine your profile with information we receive from our payment processors or other providers regarding transactions made with the same payment credentials in our restaurants.

  • Personal details, such as your name, postal and email addresses, phone number, birthday information and other contact information, when you register with our online services, log-in to Wi-Fi, enter one of our competitions, or contact us by phone or through our online services;

  • Transaction information, including information about the products you buy, prices, method of payment and payment details
  • Account information, such as your username or password (or anything else that identifies you) used to access our online services or to buy or use our products and services;
  • Profile information, including products and services you like, or times you prefer to visit us; and

We collect information through automated methods

We may use automated technology to collect information from your computer system or mobile device when you visit our restaurants, use our online services, or in-restaurant technology. Our online services and in-restaurant technology may collect information about the exact location of your mobile device or computer using geolocation and technology such as GPS, Wi-Fi, Bluetooth, or cell tower proximity. For most mobile devices and computer systems, you can disable the collection of this information by using the device or web-browser settings. Some online services and in-restaurant technology may not work properly without information about your location.

We collect information from other sources

We may collect information about you from our business partners and vendors (e.g., food delivery platforms, data providers, or payment processors) or from public sources (e.g., your public social media posts).

2. How We Use the Information We Collect

We use the information we collect for the following purposes:

  • To provide our products and services and contract with you, including payment processing and customer support;
  • To manage our relationship with you, including feedback management and for customer surveys;
  • To personalize and improve our products and services and your overall customer experience, in particular by improving our existing technologies and developing new products and services and employing profiling technology (unless we notify you separately thereof, this will not include automated individual decisions that have legal effects for you or similarly significantly affect you);

6. Targeted advertising

When you use our online services, we (and our vendors) may collect information about your activities so that we can provide you with advertising tailored to your interests.

Because we utilize advertising (“ad”) networks, you may see certain ads on other websites. Ad networks allow us to target the information we send you based on your interests, other information related to you, and contextual means. These ad networks track your online activities over time by collecting information through use of cookies, web beacons, and other technologies. The ad networks use this information to show you advertisements that may be of particular interest to you. The website and the mobile application is offered to you and is conditioned on your acceptance without modification of the terms, Conditions and notices contained herein as they exist at the time the reservation or food order is made . All use of your account by you and utilization by us of the information related to your account together with reservations you book or order for food through us are subject to the following terms, conditions and notices. Your use of this website or mobile application constitutes your agreement to all such terms, Conditions and notices. Your use of this website constitutes your agreement to all such terms, conditions, and notices. If you do not agree with these terms and conditions then you are not authorized to use this website www.nepsapp.com and mobile application NEPSAPP may extend the benefit of the arrangements in this agreement to its affiliates which offer an online food and travel service under NEPSAPP name in Nepal.

By installing, accessing or using any websites, mobile apps, email newsletters and subscriptions, and other digital properties on which these terms are posted or referenced (together, “online services”), you are entering into a binding agreement with NEPSAPP ( NEPSAPP, “we” or “us”), which controls and operates the online services from its headquarters at Laxmi Narayan Tole , Nagarjun Muncipality -4 Sitapaila Kathmanndu Nepal.

If you or your parent or guardians do not agree to these terms, then you must immediately stop using the online services and request that NEPSAPP close any online services account that you have created. You can request account deletion by sending an email to privacy@nepsapp.com please include the email address of the account that you want deleted.

3. Can I use NEPSAPP when I am travelling?
Yes, you can use/access it anywhere while travelling in all over Nepal.

4. Sending orders to restaurants.
This section applies to any orders you place using the online services. Please read this section before you send any orders to restaurants using the online services. Please note that ordering may not be available in all online services. Please refer to the FAQs for more information on ordering.

5. About ordering.
The purpose of ordering is to provide customers with a convenient way of building orders for products in advance and submitting their orders by checking in at a participating restaurant. You must register an online services account in order to use ordering. Before you submit an order, you must register a credit card or debit card (either one, a “payment card”) to use with your orders. Not all restaurants may choose to make their products available via ordering. You may need to enable location services on your device in order for ordering to function properly.

6. Registering your payment method.
McDonald’s and the restaurants use third party providers to securely store your payment card information and process your payments to restaurants. You understand and agree that, when you register a payment card, McDonald’s or its third party providers may verify that the payment card you registered is valid. You also understand and agree that when you use ordering to make a purchase from a restaurant, that restaurant will be the merchant of record. Restaurants may require information other than your order code to verify your purchase. You represent and warrant that you are of sufficient age and have all legal rights to use all payment cards you register.

7. You purchase products directly from restaurants.
When you use ordering, you submit orders directly to a participating restaurant and the contract for supplying the products will be between you and the restaurant that accepts your order. The restaurant where you collect your products is responsible for preparing the products and providing them to you. You further understand and agree that you are purchasing directly from restaurants (and not McDonald’s or any other Members of the McDonald’s system) and that neither McDonald’s nor any other Members of the McDonald’s System have any responsibility arising out of or related to any products that you purchase from restaurants using ordering. McDonald’s Corporation (which is McDonald’s parent company), its subsidiaries, affiliates, their franchisees, agents, representatives, and agencies and their officers, directors, and employees are together, “Members of the McDonald’s System”.

8. About the products in the online services.
All products are subject to availability at the restaurant where you collect your order. Some restaurants do not sell all products. Images of products and packaging on the online services are examples only and may not be identical to the product or packaging you receive from a restaurant. Differences may be due your device’s display of colors or factors such as the ingredients used, the supplier, the region of the country, and the season of the year.

9. About the prices in ordering.
Each restaurant independently determines its own prices and independently applies any additional taxes and fees as required by law. Certain offers and pricing may not be available for all orders at all locations. In the event you discover an error in the price of a product charged to you, please contact the restaurant where you purchased the product to seek a refund of the difference.

10. Building, confirming and sending your order to a restaurant.
You can use ordering to build your order and send it to a participating restaurant that you select. You do not make your purchase until you check in at a restaurant, and your payment card will not be charged until you check in at a restaurant. Orders made must be collected in person from the restaurant.

11. Checking in at a restaurant and making your purchase.
You can check in at any participating restaurant, even if you selected a different restaurant when you built your order. You make your purchase from a restaurant when you complete your check in at that restaurant.

12. Updated order totals at check-in.
Updated order totals at check-in can result from changes in products, pricing, taxes or other fees required by law due to your arrival at a different participating restaurant than you originally selected. Updated order totals can also result from the unavailability of certain products, changes in price, or other reasons.

13. Paying for your order.
You make your purchase when you complete your check in at a restaurant. When you complete your check in, you authorize the restaurant to process your order total (and if updated, your updated order total). The restaurant’s payment service provider will process your order total amount (and if updated, your updated order total amount) to the payment card you selected when you built your order. You may receive a notification within the ordering feature that the restaurant has accepted your order and is preparing it. You own the products after you have collected them.

14. Cancelling your order, refunds and your consumer rights.
You have the ability to update or abandon your order at any time until you check in your order at a restaurant. However, once you complete your check in at a restaurant, you cannot cancel it. If you desire to seek a refund for any reason, including if the products are unsatisfactory or other reasons, please contact the restaurant where you purchased the product regarding any refund due to you. Your legal rights in this respect are not affected by anything in these terms.

15. Copyright notice.
McDonald’s will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”). If you believe that your copyrighted work is infringed by content appearing on the online services, please provide a written DMCA notice to McDonald’s at: McDonald’s USA, LLC, 110 North Carpenter Street, Chicago, Illinois 60607, Attn: DMCA copyright administrator, (630) 623-3000 or by email to dmca@us.mcd.com.

16. GOVERNING LAWS
This Service shall be subject to and construed in accordance with the laws of the Government of Nepal and the parties hereby submit to the exclusive jurisdiction of the Courts of Nepal.

17. REFUND POLICY
NEPSAPP takes customer satisfaction very seriously. In the case of problems with your food order, please contact us. In appropriate cases, NEPSAPP will issue full or partial refunds. For example: if you did not receive your order or received an incorrect order, you may be issued a full refund; if part of your order is missing, we may issue a partial refund. In every event, we will do our best to ensure your satisfaction.

18. What to include in your infringement notice.
Please include the following information in your notice to us, along with your full name, address, telephone number and email address:

  1. A detailed description of the copyrighted work that you believe has been infringed.
  2. A detailed description of the content on the online services that you believe infringes the copyrighted work, including information reasonably sufficient to permit McDonald’s to locate the alleged infringing content (e.g., the page on the online services where the alleged infringing content is located).
  3. The following statement, signed by the copyright owner or a person authorized to act on behalf of the copyright owner of an exclusive right that is allegedly infringed: “I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law. I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the copyright owner of an exclusive right that is allegedly infringed.”

  1. The platform may be under constant upgrades, and some functions and features may not be fully operational.
  2. Due to the vagaries that can occur in the electronic distribution of information and due to the limitations inherent in providing information obtained from multiple sources, there may be delays, omissions, or inaccuracies in the content provided on the platform or delay or errors in functionality of the platform. As a result, we do not represent that the information posted is correct in every case.
  3. We expressly disclaim all liabilities that may arise as a consequence of any unauthorized use of credit/ debit cards.
  4. You acknowledge that third party services are available on the platform. While the materials provided on the platform were prepared to provide accurate information regarding the subject discussed, the information contained in these materials is being made available with the understanding that we make no guarantees, representations or warranties whatsoever, whether expressed or implied, with respect to professional qualifications, expertise, quality of work or other information herein. Further, we do not, in any way, endorse any service offered or described herein. In no event shall we be liable to you or any third party for any decision made or action taken in reliance on such information.
  7. The information provided hereunder is provided "as is". We and / or our employees make no warranty or representation regarding the timeliness, content, sequence, accuracy, effectiveness or completeness of any information or data furnished hereunder or that the information or data provided hereunder may be relied upon. Refund Policy

  • The total amount paid during subscription will be refunded if corporate/business wants to terminate our subscription within 15 days.
  • The corporate/business member must make an initial charge of Rs.5100, which will serve as a security deposit upto 3 months and will be refunded if the subscription is terminated within three months of the subscription date.
